Agreement Overview

Welcome to Elevate Sports Recruiting. These Terms of Service ("Terms") constitute a legally binding agreement between you and Elevate Sports Recruiting, LLC ("Company," "we," "our," or "us") regarding your use of our website, platform, and services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Binding Agreement

By creating an account, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. This agreement takes effect immediately upon your first use of our services.

Age Requirements

Our services are intended for individuals who are at least 13 years old. If you are under 18 years old, you represent that:

  • You have obtained consent from your parent or legal guardian
  • Your parent or guardian has reviewed and agreed to these Terms
  • You understand the nature of college recruiting services
  • Your use of our services is for legitimate educational and athletic purposes

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent website notice. Continued use of our services after changes constitutes acceptance of the new Terms.

Our Services Include

  • College football recruiting database and search tools
  • Best Fit Tool for matching student-athletes with appropriate programs
  • Recruiting profile creation and management
  • Coach contact information and communication tools
  • Educational resources and recruiting guidance
  • Analytics and progress tracking

Service Limitations

Our services are tools to assist in the college recruiting process. We do not guarantee:

  • College admission or athletic scholarship offers
  • Coach responses to communications
  • Accuracy of all third-party information
  • Availability of specific recruiting opportunities

Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may temporarily suspend services for maintenance, updates, or technical issues. We will provide advance notice when possible for planned maintenance.

User Accounts

Account Registration

  • • Provide accurate and complete information

Account Security

  • • Choose a strong, unique password
  • • Keep login credentials confidential
  • • Notify us of unauthorized access
  • • Log out from shared devices

User Conduct & Prohibited Activities

  • Using the platform for legitimate recruiting purposes

Prohibited Activities

  • Harass, threaten, or abuse other users
  • Spam coaches or other users
  • Attempt to hack or compromise our systems
  • Share copyrighted content without permission
  • Create multiple accounts
  • Use automated tools or bots
  • Resell or redistribute our services
  • Interfere with other users' experiences

NCAA Compliance

You are responsible for ensuring your recruiting activities comply with NCAA rules and your school's policies. We provide general guidance but you should consult with your school's compliance office for specific questions about recruiting rules and eligibility requirements.

Content & Intellectual Property

Your Content

You retain ownership of content you upload (photos, videos, personal information, etc.). By uploading content, you grant us a license to:

  • Display your content to college coaches and relevant parties
  • Store and process your content on our servers
  • Make necessary technical modifications for platform functionality
  • Use aggregated, anonymized data for platform improvements

Content Removal

We may remove content that violates these Terms or our policies. We may also remove content that we believe is harmful, offensive, or violates the rights of others.

Our Intellectual Property

All platform content, features, and functionality are owned by us and protected by intellectual property laws. This includes:

  • Software, algorithms, and platform technology
  • Logos, trademarks, and branding materials
  • Database compilation and organization
  • Content we create (guides, articles, resources)

Content Standards

All content you upload must:

  • Be accurate and truthful
  • Not violate any third-party rights
  • Be appropriate for a professional recruiting environment
  • Comply with applicable laws and regulations
  • Not contain malicious code or harmful content

Content Removal

We reserve the right to remove any content that violates these Terms, is reported by other users, or that we deem inappropriate. We will make reasonable efforts to notify you before removing content, but we may remove content immediately if necessary.

Payment Terms & Subscriptions

Subscription Plans

  • • Premium subscription: $100/month
  • • Annual discount available (15% off)
  • • Free tier with limited features
  • • Family and military discounts available

Payment Processing

  • • Secure payment processing via Stripe
  • • Automatic recurring billing
  • • Payment due at start of billing cycle
  • • Failed payments may suspend service

Cancellation & Refunds

  • • Cancel anytime with no penalty
  • • Service continues until end of billing period
  • • Prorated refunds for annual subscriptions
  • • No refunds for partial months used

Price Changes

  • • 30-day advance notice for price increases
  • • Existing subscribers locked in for billing cycle
  • • Option to cancel before price change
  • • Promotional pricing may have different terms

Money-Back Guarantee

We offer a 30-day money-back guarantee for first-time subscribers. If you're not satisfied with our premium services within the first 30 days, contact our support team for a full refund. This guarantee applies only to your first premium subscription and does not apply to renewal payments.

  • Specific results from using our platform

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the amount you paid for our services in the 12 months preceding the claim. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, opportunities, or data
  • Damages resulting from third-party actions
  • Issues arising from your misuse of our services

Third-Party Services

Our platform may integrate with or link to third-party services (payment processors, video hosting, etc.). We are not responsible for the availability, content, or practices of these third-party services. Your use of such services is governed by their respective terms and policies.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

General Provisions

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes will be resolved in the courts of Dallas County, Texas.

We encourage resolving disputes through our customer support team first. For formal disputes, we offer mediation services before pursuing litigation.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our services.
